Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pixie mobile application and the website at getpixie.site (together, the "Service"), operated by EverAfter Travel, LLC ("EverAfter Travel," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

This document is provided as a general template and does not constitute legal advice. Before public launch, have it reviewed by qualified counsel to confirm it fits the Service's actual features, pricing, and jurisdiction.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms.
Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems.
Upload content that is unlawful, infringing, harmful, or that violates the rights of others.
Use the Service to send spam or collect information about other users without consent.

4. User Content

You retain ownership of content you submit to the Service (such as reviews, photos, and trip plans). By submitting content, you grant EverAfter Travel a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content solely to operate and improve the Service. You are responsible for ensuring you have the rights to any content you submit.

5. Purchases & Subscriptions

The Service may offer paid features, one-time purchases, or subscriptions. Prices and terms will be shown at the point of purchase. Payments are processed by our payment provider (Stripe) or through the applicable app store. Except where required by law or the app store's policies, purchases are non-refundable. Subscriptions renew automatically until canceled.

6. Intellectual Property

The Service, including its design, branding, "Pixie" name and marks, and software, is owned by EverAfter Travel and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without prior written permission.

7. Third-Party Content & No Affiliation

The Service provides information about theme parks and related attractions for planning and entertainment purposes. Pixie is an independent product and is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or its affiliates. All third-party names and marks are the property of their respective owners. Information such as hours, availability, and pricing may change and is not guaranteed to be accurate.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

9. Limitation of Liability

To the maximum extent permitted by law, EverAfter Travel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50).

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Hillsborough County, Florida.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
